Real Estate and Construction
We have extensive knowledge in real estate and construction matters as we have worked on several development projects and construction claims. Our main role is to ensure compliance with related rules and regulations throughout the construction project in addition to advising on zoning regulations and liaising with ministries and municipalities. Our experience includes advising on laws and licensing requirements for Lebanese and Non-Lebanese purchasers and sellers, identifying legal risks, obtaining relevant authorizations, permits and decrees, preparing a wide range of complex contracts and legal documents including purchase agreements, agreements with contractors, service providers and consultants. We further advise on estate management and community arrangements. We have experience in handling contractors claims in relation to issues related to Performance Bond, Extension of Time, Retention, War claim, Acceleration, Force Majeure, Disputed Variation Orders, Defects Liability Certificate, Liquidated Damages, Counterclaim by the Employer, Subcontractor issues (and proceedings by subcontractors) in addition to Settlement Agreements and Arbitration of unsettled disputes (including preparing for arbitration procedure).
As a way of example, we represent a large developer for a marina mixed-use community and advised them on all related legal matters from inception to completion of the project and are currently serving as its legal advisor for post completion and estate management. We have further advised on contractor claims for a construction project of a 4 stars hotel on behalf of the client. We have further advised and negotiated several settlement agreements with contractors.
